In early November of 2009, 4-year-old Luca Moya of Beeville was killed in a tragic truck accident outside of Goliad, TX. The fatal accident occurred as the young child was traveling with his mother on U.S. Highway 59 when an 18-wheeler struck the side of the their vehicle. The child died at the scene and his mother, Emika Moya, was transported to an area hospital before being flown to Corpus Christi for treatment of serious injuries.

A truck driver lost his life when a car came into his lane forcing him off of the road
On November 16, 2009, a truck driver lost his life when a passenger car forced him off of the road. The fatal truck accident occurred at approximately 2:30 p.m. on Route 9 near the Westchester-Putnam county line in New York when a driver lost control of her car and swerved into oncoming traffic and into the path of an 18-wheeler. The driver of the 18-wheeler swerved to avoid hitting the car head on. In doing so, the tractor trailer struck a tree causing the vehicle to burst into flames. The unidentified truck driver died at the scene. The driver of the passenger car suffered serious injuries and was taken an area hospital.

A truck driver lost her life in an 18-wheeler accident in Houston, by Texas truck accident attorney Michael Grossman
On November 20, 2009, the driver of an 18-wheeler was killed in a truck accident on the 2600 block of I-10 near Houston, TX. The accident occurred at approximately 3:30 a.m. as the unidentified female driver of the truck was believed to have lost control of her vehicle, causing her to collide with a concrete pillar beneath an overpass. No other vehicles were involved in the accident. The truck driver died at the scene.
In these types of single-vehicle truck accidents, it is easy for everyone to assume that the truck driver fell asleep at the wheel or that the accident was their fault entirely. 27-year-old Jeremy Jay of Edgefield killed in 18-wheeler accident, by Dallas truck accident lawyer Michael Grossman
On October 26, 2009, 27-year-old Jeremy Jay was killed in a truck accident in Edgefield County. The accident occurred in the morning hours as Jay was driving a pickup truck behind a big rig. The cargo on the rear of the commercial vehicle snagged the overpass and was forced off of the rear of the trailer onto Jay's car. He was killed instantly.
This is a terrible tragedy. I am surprised this accident has not received more media coverage. Many more obscure trucking accidents get plenty of media coverage, but this one seems to have barely made an appearance on the news. That is sad.
Naturally, if this young man was married or if he had children (or both), these immediate family members would have the most obvious wrongful death claim against the trucking company. Additionally, there are other family members that may have claims as well, depending upon the circumstances of the case. Hopefully, his family has retained a truck accident attorney and intends to hold this trucking company responsible for such an absurd oversight.

Vaughn Gentry of Dallas and Albert Pruitt of Addison, Texas lost their lives in a tragic 18-wheeler accident case.
On Monday night, two local truck drivers were killed in a tragic accident in Texarkana. The accident occurred at approximately 2:30 a.m. as 51-year-old Albert Pruitt of Addison and 43-year-old Vaughn Gentry of Dallas were traveling in an 18-wheeler that was hauling a load of paper products on I-30. For reasons not yet determined, the truck was unable to decelerate in time enough to avoid crashing into a passenger car. Upon impact, both vehicles burst into flames and all occupants of both vehicles died at the scene.

64-year-old Victory Barker and 77-year-old Walter Carpenter were killed in an 18-wheeler accident near Texarkana
A horrific trucking accident near Texarkana claimed the lives of 64-year-old Victory Barker and 77-year-old Walter Carpenter. The tragic accident occurred at approximately 2:30 a.m. as the vehicle Barker and Carpenter were traveling in was either stopped or slowed down for construction traffic. A tractor-trailer approached from the rear and struck the passenger car. Both vehicles were consumed in a violent explosion killing everyone in both vehicles.
In my 20 years of representing the victims of truck accidents I have seen many "types" of trucking accidents. Lately, there has been a dramatic increase in these types of construction zone related accidents. Naturally, when a vehicle that weighs approximately 3,000- 4,000 lbs is struck by a vehicle weighing tens of thousands of lbs (fully loaded in accordance with the law, the truck may weigh in the 80,000 lb range) , the result is seldom good. But when you have such a massive object strike an object that is sitting still, the results are unimaginably devastating.
The families of both victims will have a wrongful death claim against the trucking company. There may also be other defendants. For example, the contractor that was overseeing the construction site may have failed to properly warn the truck to slow by not using appropriate signage, the fact that one of the vehicles exploded on impact may be due to a defective in either vehicle, or if the driver of the truck was under the influence of any type of alcohol (this is just an example and there has been no mention of such by authorities) then a bar or restaurant may be responsible as well.

You can't control what sort of jury you're going to get and yet the entire case hinges on the jury's decision. Both the plaintiff's attorneys and the defense counsel wish to avoid the random nature of a jury trial as much as possible.
Thus we meet with a mediator. The mediator is typically a retired judge or attorney who has extensive experience in the legal field but can also offer a neutral perspective on the case at hand. When mediation begins, the mediator will listen to opening statements from both sides and then the mediator separates the plaintiff's attorneys from the defense counsel. The mediator then goes back and forth between each party, listening to arguments and counter arguments, attempting to get a feel for what would happen if the case went to trial. With this information, the mediator attempts to bring both parties to a settlement that they all find agreeable.
Naturally, this process is much less stressful for the client than a trial so we attempt to resolve as many cases in this manner as possible. We are not, however, unwilling to go to trial. On the contrary, we will do whatever it takes to get a fair settlement for our clients.
