Dallas Texas truck accident attorney Michael Grossman discusses the importance of investigating an 18 wheeler collision

If you’ve been involved in an accident with an 18-wheeler, your success in court depends on your lawyer’s ability to prove that the truck driver is to blame for your accident. This involves a meticulous investigation of the facts surrounding in your case. Some of the evidence that may be the key to your case includes:

  • Logs from the transportation company
  • The transportation company’s safety record
  • The driver’s safety record
  • The driver’s training and qualifications
  • Reports from police about the accident
  • Records of maintenance or malfunctions with the truck or trailer equipment
  • Witness statements, photographs, or other evidence gathered from the scene of the accident
  • Data from the truck’s GPS or black box recorder
  • Proof of the driver’s activities prior to the accident, i.e. restaurant/gas station receipts, cell phone records, etc.

Any one of these could be the key to getting fair compensation. You must talk to an experienced truck accident attorney as soon as possible in the event of an accident. The insurance company’s defense attorneys and insurance adjusters will try to contact you quickly, before you’ve sought legal advice. Make sure you do not offer any statements to them before talking to a lawyer.

The truck driver’s insurance company has one goal: to pay you as little as possible. Don’t let their hardball negotiation tactics make you accept less than your claim is worth. The Dallas truck accident attorneys of Grossman Law Offices have twenty years of experience winning truck accident cases and we can help you get the compensation you deserve.

Dallas truck accident lawyer Michael Grossman discusses accident involving flatbed trailers

Flatbed Trailer Accidents

Flatbed trailers are the kind used to transport goods too large to fit in a normal cargo container.  As you can likely imagine, when this cargo falls off the trailer and collides with another vehicle, the results are usually devastating.

These types of cases often involve multiple defendants.  Obviously, the truck driver and his or her insurance company would be at least somewhat to blame.  If the cargo was improperly secured or fastened, the company that loaded the cargo would be partially liable as well.

If the accident resulted from the truck’s collision with another vehicle, that other vehicle could also be partly liable for causing the accident.  The organization that planned the truck’s route might even be liable if the accident resulted from the truck’s collision with a tree or power line.

With this many variables involved, you need the help of an experienced attorney.  The truck accident lawyers of Grossman Law Offices in Dallas have twenty years of experience with flatbed trailer accidents and we can help you with your case as well.

Dallas tractor trailer accident attorney Michael Grossman discusses accidents involving falling cargo

Dallas Tractor Trailer Accidents Involving Falling Cargo

With all the construction going on in the Dallas area, we are seeing an unfortunately high number of accidents involving cargo falling from tractor trailers. These cases create unique difficulties, above and beyond the usual problems that victims face when trying to go after commercial transport companies.

These types of cases often involve multiple defendants. For example, if the cargo was loaded onto the trailer by a company other than the one that owns the truck, that loading company may be partially liable for improperly securing the load.

Sometimes the equipment used to secure the cargo or even the trailer itself are defective.  In these cases, the companies that manufactured the equipment could be a defendant as well if it was determined that the accident resulted due to a faulty product.

If the accident resulted from a collision with another vehicle, the driver of the other vehicle may be liable as well.  Or if the cargo was forced off the trailer due to a collision with a tree, power line, overpass, or some other stationary object, the organization that planned the truck's route could be to blame.

Our Attorneys Know How to Properly Investigate Such Events

Sometimes even finding the defendants can be difficult.  In cases involving fallen cargo, the truck driver is often unaware that an accident has even occurred.  Other times, he or she may flee the scene.  Tracking down the driver and then determining the cause of the crash then becomes much more difficult.

The complex nature of these sorts of cases can be overwhelming for those unfamiliar with commercial vehicle accident law.  The Dallas tractor trailer accident attorneys of Grossman Law Offices have twenty years of experience with cases involving fallen cargo.  We can help you track down all potential defendants in your case in order to get the compensation you are owed.

Obstacles in a truck accident case

Truck Accidents and Their Potential Legal Difficulties

If you’ve been in an accident involving a large commercial vehicle, chances are you’ve seen the kinds of damage these trucks can cause.  The results of these collisions can be simply devastating.  Unfortunately, the process of seeking financial compensation is no less daunting.

What makes it so hard?

It all comes down to money. The commercial insurance policies that cover these large trucks are priced according to the damages these vehicles can cause. These policies are typically valued 50 times higher than the policies that cover passenger cars. With that sort of money on the line, insurance companies are going to do everything they can to avoid paying up.

The driver of the vehicle is, unfortunately, not on your side either. His or her entire career is probably at stake in this case and he or she might do whatever it takes to get out of trouble, even if you’re the one who ends up paying for it.

To make things worse, the laws surrounding these accidents are complex to people who do not work with the laws on a regular basis. Commercial vehicles are regulated by the Federal Motor Carriers Safety Administration. These regulations create overlap between federal and state laws that allows insurance carriers to deny your claim based on a technicality you’ve never even heard of.

What will these insurance carriers do to avoid paying me?

The insurance companies you will face in a truck accident will typically employ a team of experts, starting with the most ruthless and aggressive insurance adjusters in the business.  These people have proven their ability to deny claims just like yours time and time again.  They will be working around the clock to make sure their company doesn’t have to pay you.

In addition, commercial insurance carriers typically have a team of defense attorneys and accident recreation experts on retainer.  This team will be sent to the scene of your accident before the truck driver has even left.  Their job is to build a legal case against you using evidence from the scene, witness statements, or anything else they can find.

What can I do?

You can get a team of your own. The Dallas Fort Worth truck accident attorneys of Grossman Law Offices have twenty years of experience working with cases just like yours, making sure insurance companies take responsibility for their clients’ mistakes. Before you make a move in your truck accident case, make sure that you speak with a qualified attorney.

Dallas attorney Michael Grossman discuses big rig accident cases

If you've been involved in an accident with a big rig, you've probably realized that the damages caused by these collisions can be catastrophic.  If you're considering pursuing a claim against the trucking company or their insurance carrier, there are some facts about big rig cases that you need to consider.

More Money Is Involved: Big rigs and their drivers are covered by commercial insurance policies that are generally 50 times more valuable than policies that cover passenger cars.  With this much money involved, insurance carriers are going to be much more tenacious in trying to deny your claim.

The Insurance Adjusters Will Be Ruthless: Commercial insurance carriers employ the most aggressive and experienced insurance adjusters in the business.  These people are the ones who can deny claims just like yours time and time again and their sole purpose is to find some way to make this accident your fault or to find some technicality to deny your claim.  Their paycheck is on the line too and they won't be doing you any favors.

A Team Of Experts Working Against You: Commercial insurance carriers also have a specialized team of defense attorneys and accident recreation experts on retainer.  Before the driver of the big rig has even left the scene of the accident, this team will be there, looking for the smallest bit of evidence that they can use to avoid paying you.  It could be anything from physical evidence from the crash to your own statement.  They will be working night and day to build a case against you.

The Laws Are Complex: Big rigs are regulated by the Federal Motor Carriers Safety Administration.  These regulations create gray areas between federal and state laws that insurance carriers can use to deny your claim based on a technicality you've never even heard of.

The Big Rig Driver Isn't On Your Side: Chances are, the big rig driver's entire livelihood is at stake.  If you win this case, his or her career could be finished.  He or she might be willing to say anything to get off the hook, even if it hangs you out to dry.

With so much at stake, it is important to speak with an experienced truck accident attorney. The sooner you can do so, the better off you will be.
