Legal dangers of the modern 18 wheeler insurance provider.

 

I have worked on 18 wheeler accident lawsuits for twenty years.  Over the course of my work, I have seen the strategies used by insurance companies evolve greatly.  Twenty years ago, the massive insurance carriers that covered 18 wheeler companies acted differently -- ostensibly, at least.  Twenty years ago, these insurance carriers would fought fight tooth and nail to avoid paying out, aggressively denying any claims of liability in an accident.  But this strategy had problems.  Ultimately, this strategy was driving more and more people to seek out attorneys to help them fight the legal battle.  Obviously, insurance companies didn't like this.  So roughly five years ago, they began to change how they handled victims of 18 wheeler accidents.

In the past five years, insurance companies have been acting friendly, accepting responsibility for your damages, and just generally being cooperative with those people injured by their clients.  This may seem like a good thing for the victims of 18 wheeler accidents.  But the truth is, the insurance companies are manipulating the victims.  They have found that, if they are passive and complacent, victims are not nearly as likely to hire an attorney.  They combine this complacency with endless delays and stalls.  They drag out investigations, and they ask victims countless questions about their accident.  Essentially, they are fishing for specific pieces of information that can allow them to deny or drastically reduce your claim.  They just want a way out.

This strategy presents two unique problems to victims.  Firstly, the longer insurance adjusters have to fish for information, the more likely they are to find something they can use against you.  But more importantly, the longer they have to ask questions, the more damage is done to your case.  They're using these delays for a very specific purpose.  They're hoping that, by the time you realize how deceitful they're being, your case will be irreparably damaged and no attorney will take it.  You will then be forced to accept a small offer because you will have no other options.

Today, it is more important than ever that you seek out an experienced Texas trucking attorney if you are hurt in an 18 wheeler accident.  Just remember that, above all, the trucking companies and their insurance carriers care about their bottom line.  You will need someone on your side who can fight these companies on their own terms, someone who can force them to offer you the settlement you deserve.  If you are hurt by an 18 wheeler, make sure that the people responsible accept liability for their actions.
