Commentary I hope both victims experience a full recovery from the accident. Failing to control one's speed, especially within a commercial vehicle, is a very dangerous thing on the highway. Though the driver was ticketed, to be compensated in the accident, a plaintiff must still adequately prove that the accident was caused by the defendant's actions. This requires proving that the defendant owed the plaintiff (and other motorists) a duty on the roadway, normally safe vehicular operation, and that this duty was breached by the defendant's actions. With this breach, a victim may have the opportunity to collect damages in areas like medical bills, lost wages, and pain and suffering.
