Pat Buzbee Killed in Collision with Commercial Vehicle That Failed to Stop at Light in Porter, Texas
According to the Montgomery County Police Reporter, a county official was killed in an accident involving a commercial vehicle in Porter, Texas. The wreck occurred shortly before 3 p.m. Monday, February 20 when three vehicles approached a red light on FM 1314. The driver of a medical waste company failed to stop at the light, swerved out of the way of the truck in front of him, and side swiped an SUV in the roadway. The SUV's driver, 65-year-old Pat Buzbee, was caught in the vehicle as it began to roll. He was pronounced dead at the scene. Police continue to investigate the accident.
Commentary In some of my blogs I speak to how a driver's actions are often compared to what is reasonable at the time of an accident. In this particular incident, it would be reasonable for a driver to stop at a stop light. If unable to stop, it may then become reasonable for the driver to swerve away from traffic, to avoid striking a vehicle in front. However, swerving into traffic is probably very contrary to what would be expected in the given situation. If this is proven true by police reports and a third party investigation into the accident scene, this unreasonable behavior could form the basis of a cause of action against the truck driver. This separate inspection into the scene is necessary, as attorneys for the truck driver and trucking company will try to argue their client's maneuvers diffused greater catastrophe.
