Five Injured Including Ana Posada, in Early Morning 18-Wheeler Accident in Westchester, Florida
According to WSVN, five people were hurt in an accident involving a passenger car and an 18-wheeler in Westchester, Florida. The wreck occurred around 2:30 a.m. Friday, February 17 when police and witnesses believe the driver of the rig in the far right lane of Coral Way, made a quick move toward the inner lanes. The truck and a Honda Accord struck, injuring five inside. One of the victims has been identified by a family member as Ana Posada. The four other victims have not been identified and their statuses are unknown.
Commentary One article notes the thought that speed may have been a factor in the accident. However, if the witness account is accurate and the Honda was even or near-even with the rig at the time of the accident, I fail to see how this is a relevant factor. My firm has litigated several 18-wheeler accidents that involve a trucker abruptly switching lanes and in just about each one, driver inattention is the relevant factor. Due to some blind spots along either side of the trailer, a trucker must be aware of their surroundings more so than a passenger vehicle driver. Perhaps this disparity is not fair to some, but it is the nature of commercial hauling. To determine what civil strategies are available, a third party investigation should inspect both vehicles in question, while deposing the truck driver and the driver of the Honda. The relationship between the Honda's position and the truck should be established, as defense attorneys will use this thought of excessive speed as a key defense for their client (the trucking company).
