Commentary When you
couple foggy conditions with a slow-moving vehicle, the likelihood of
an accident increases. Some may argue that nothing could have been done
to stop this accident, due to the fog. However, when you drive
commercially, something has to be done to limited danger. Does that mean
waiting the fog out, or driving on the shoulder with hazards on until
the truck is up to speed? In my experience handling commercial vehicle
accidents, there are usually maneuvers or safety protocols in place, yet
they are not followed. This is precisely why I normally advocate the
use of an independent investigation following a commercial vehicle
accident. The stakes are just too high and the variables are too extreme
to solely rely on police reports. Regarding those stakes,
when you have an insurance policy that surpasses the million dollar
mark, trucking companies are probably justified hiring the best defense
attorneys available. And of course the inherent problems with trucking
company attorneys are twofold. First, they are very good at what they
do, which is picking apart anything related to liability towards their
client. Second, most of us (thankfully) will never experience a
commercial vehicle accident. So when one does occur, victims are
typically left reeling in the aftermath. Yet, defense attorneys rip
apart accident scenes and police reports all the time. With plaintiffs
having to prove negligence to have a claim, a third party investigation
is the minimum that should occur following a truck accident.
