Derek Simoneaux Killed in 18-Wheeler Accident near Whitehouse, Texas

 


According to KETK, a man was killed in an accident involving an 18-wheeler, a motorcycle, and a passenger vehicle near Whitehouse, Texas. The incident occurred around noon Monday, January 23 when Texas DPS officials believe the motorcycle of 26-year-old Derek Simoneaux clipped an 18-wheeler around a corner on FM 848. The motorcycle broke in half and caught fire, killing Simoneaux at the scene. The accident remains under investigation.

Commentary
This is the problem with accident reporting, as the statement that the motorcycle clipped an 18-wheeler could mean the world in liability. The positioning of the vehicles makes all the difference in determining if remedies are available from the accident. Therefore, an independent investigation would need to get out to the accident scene and examine tire marks, inspect both vehicles, and interview any witnesses.
We recently litigated a truck accident where the rig began to veer onto the median at a turn in the roadway. The front of the tractor portion struck the front left side of our client's vehicle, inflicting serious damage and injury. From the skid marks on the roadway and the damage to the front ends, we were able to prove that the trucker had allowed the rig to be positioned in an imminently dangerous fashion. You have to be precise in these determinations as defense attorneys are very good at defending their employer's lofty insurance policies.
