4-Year-Old Toddler Ejected from Vehicle following 18-Wheeler Accident in Big Spring, Texas
According to CBS 7, a 4-year-old toddler was injured in an accident with an 18-wheeler in Big Spring, Texas. The accident occurred Thursday, January 19 when police believe a big rig traveling west on I-20 tried to switch lanes. The driver of a passenger vehicle tried to avoid the rig and in doing so, lost control of the vehicle causing it to rollover. A 4-year-old girl was ejected from the vehicle and airlifted to a hospital in Lubbock, Texas. The child's mother was taken to a hospital in Big Spring, where her injuries were unknown.
Commentary My goodness, I sincerely hope the young child fully recovers from the accident. Unfortunately, we have litigated several accidents in the past where a trucker switched lanes without checking the length of their trailer for passenger vehicles. Just a small collision can produce great consequences, as evidenced in this accident. To begin the process of seeking compensation, a third party investigation should be used to concrete liability, as this is a highly contentious issue when dealing with truck accident defense attorneys. Because 18-wheelers hold insurance policies approaching or even surpassing 7 figures, the goal of any defense attorney is to deny or reduce an accident claim. Depending on the trucking company, this is accomplished a number of different ways. The most common route they take is conducting their own investigation, as soon as possible. In one of the cases we litigated, we received accident photos with the police report, and observed defense attorneys in the background of some of the pictures. This can be disheartening to a victim when they see the opposition attempting to negate or reduce their claim so quickly.
