investigate the accident.
Commentary With the
few details provided, it is difficult to ascertain liability or
possible remedies from the accident. Several questions come to mind
following the statement that the rig was pulling over onto the shoulder
of the highway. Was there a mechanical failure on the rig? Did the
driver give ample warning that he needed to pull the rig off the road,
and were safety warnings functioning correctly when they did so? Of
course, none of these are answered by the news piece and highlight the
value of an independent party investigating the accident scene.
Certainly many may question the role of driver error in the
accident, on both ends. This is obviously a possibility, but the real
question regarding possible remedies is how much did driver error or the
aforementioned possibilities factor into the accident. You see,
liability is typically not an all-or-nothing entity, meaning juries are
tasked with deciding just how much of a role each factor played into the
outcome of the incident. This determination is then used in developing
strategies towards compensation.
