According to KHOU, a man was in serious condition following an accident
with an 18-wheeler in Houston, Texas. The accident occurred around 3
a.m. Saturday, January 14 when authorities believe a man driving an SUV
did not yield to traffic on Fairbanks North Houston and was then struck
by an 18-wheeler. The driver of the SUV was airlifted to a local
hospital where he was listed in serious condition.
Commentary I hope
the driver of the SUV experiences a full recovery from the accident.
Though the news article seems to place explicit fault on the driver of
the passenger vehicle, it is typically advisable to investigate against
this claim. I've mentioned in the past that liability is commonly not an
all or nothing proposition. In other words, it may be shared between
multiple parties. Now, many may see that a driver pulled in
front of a truck and ask how liability could be shared. Imagine a
scenario where the truck driver was speeding, causing the SUV driver to
misjudge the distance when pulling onto the roadway. He still did not
yield right of way, certainly incurring some fault, but the cause of the
accident may not entirely be his own.
