Truck Driver Injured in Single-Vehicle Accident in Conroe, Texas
According to Your Houston News, the driver of an 18-wheeler was injured
when their rig was involved in a single-vehicle wreck in Conroe, Texas.
The accident occurred around midnight Thursday, January 12 when the rig
was involved in a one-car wreck and later caught fire on Interstate 45.
The driver of the truck was taken to a local hospital where he was
listed in stable condition. Authorities continue to investigate the
accident.
Commentary We all
hope the driver of the rig fully recovers from the accident. One of the
news feeds identifies the driver as working for UPS, which would
presumably mean the accident occurred while on the job. If this is
accurate, typically an administrative claim is filed within the state's
workers' compensation program, provided the driver's employer is a
subscriber to the policy. While proponents of the system tout
the attributes of no-fault compensation, the reality of the situation is
a shield from lawsuits against employers, even if fault is found on
their behalf. Furthermore, because victims may sometimes deal with
employer-guided physicians, severity of injuries may be argued. In other
words, there are ways to limit the compensation a victim receives from
workers' comp. It should be noted that more than likely, the
only other possibility other than workers' comp is a claim against a
truck's manufacturer or service provider, if a defect were to be found
that led to the accident. This information is only extolled through the
employ of a third party investigation, which would be tasked with
inspected the truck in question.
