Dong Hyun Kim Killed in Accident with 18-Wheeler in McKinney, Texas
According to KWTX, a man was killed when he lost control of his vehicle and was then struck by an 18-wheeler in McKinney, Texas. The accident occurred Monday morning, December 19 when police believe 20-year-old Dong Hyun Kim struck a highway barrier on the Sam Rayburn Tollway and spun into the path of a semi truck.
Commentary Though some news feeds mention that no criminal charges are pending in the accident, that does not negate the possibility of a civil claim to restitution. Accidents involving 18-wheelers are some of the most complex events to unravel and can include more than one theory of liability. Because of the intricate nature of these events, an investigation should be used to inspect both vehicles in the accident and make a clear liability determination. Some may view this accident or other similar instances as one-sided, but rarely from a liability perspective is that the case. This is because many actions and decisions by involved parties at the time of an accident can play a tangible role. For instance, imagine a scenario where the truck driver is following the young man's vehicle too closely and any deviation would make an accident imminent. This could place some fault on another party, other than completely being on the victim. Conversely, the victim's vehicle should be inspected for manufacturing defects or design flaws that could have caused the accident. We litigated a case in the past where a vehicle lost braking function on a highway. Unfortunately, these problems are typically only made apparent at the worst possible time. Certainly my post is speculative until an investigation can look into the accident, but really my point is that no commercial vehicle accident is cut-and-dry. More commonly, multiple parties holds liability, which may not be apparent at the scene.
