Sean Green Killed, Krysta Tipsword Injured in Collision with 18-Wheeler in Midland, Texas
According to News West 9, one teenager was killed and another serious injured in an accident with an 18-wheeler in Midland, Texas. The accident occurred early Wednesday morning, December 14 when investigators believe 18-year-old Krysta Tipsword pulled in front of the big rig. Tipsword's passenger, 19-year-old Sean Green was killed in the accident, while Tipsword remains in critical condition at Midland Memorial Hospital.
Commentary Though very few details are currently present, I can unequivocally say this is a tragedy. I hope the driver pulls through and experiences a full recovery. Though the news feed seems to arbitrarily fault the teen driver, without a doubt, an independent investigation should be used for accident recreation. The investigation would be tasked with providing details about both drivers actions prior to the accident. This could extol possible civil remedies that are probably not apparent from a police report. For instance, if the truck driver was speeding prior to the accident, this could place some liability on trucker and in turn their employer, through agency law. For those who do not know, this data is obtainable through a download of the truck's Electronic Control Module, which would show investigators the truck's RPM rate at the time of the accident. Obviously with so little details at the moment regarding the incident, this is little more than educated guesses at this point.
