Four People Injured in Accident with U.S. Mail 18-Wheeler in Weslaco, Texas


According to KRGV, four people were injured in an accident with an 18-wheeler contracted by the U.S. Postal Service in Weslaco, Texas. The accident occurred around 2:30 p.m. Thursday, December 8 when the 18-wheeler struck a cement wall and then another vehicle along Expressway 83. In total, one female and three juveniles were injured in the accident.

Commentary
When few (if any) details are revealed regarding the cause of an 18-wheeler accident, a third party investigation should be used to determine liability. In my experience when it comes to a commercial vehicle accident, the possible factors run the gamut.
Typically the first issue an investigation would look into is on the rig itself. Though many are quick to initially blame a truck driver, they should be aware that rigs possess thousands of components that all must work in concert to perform a successful haul. Just yesterday I read about an accident involving an 18-wheeler whose brakes locked up in the middle of a haul. These are the types of issues that could fault an owner of a rig (who is tasked with maintaining their fleet and providing a safe vehicle for truckers) or a service shop tasked with servicing the vehicle.
Of course on the other hand, issues like trucker inattentiveness, excessive speed, or aggressive driving could place fault on the truck driver. Through agency law in Texas, this would in turn make the owner of the rig vicariously liable as well, as they have accountability over the actions of their employees.
Point being, liability is not a determination that is made at the time of the accident. It is actually determined over weeks, if not months, of studying into the accident itself.
