Two Injured Following Chain-Reaction Accident Involving 18-Wheeler in Waco, Texas


According to KWTX, two people were injured following a chain-reaction accident involving an 18-wheeler in Waco, Texas. The accident occurred Tuesday afternoon, December 6 when the driver of the 18-wheeler was forced to stop the rig on Interstate 35 due to the brakes locking up. A driver of a van then stopped behind the truck, but the driver of a F-150 was unable to stop and struck the van, pushing it into the 18-wheeler. Two elderly occupants inside the van were taken to Hillcrest Baptist Medical Center with what are thought to be non-life threatening injuries.

Commentary
I hope the two injured in the van fully recover from the accident. An investigation into this accident would be interesting, as multiple parties could have played a role in the event. When separate parties do play a role in an accident, liability could be shared according to the parties' involvement.
Let's start with the 18-wheeler. The article notes a braking failure which forced the driver to stop on the highway. The investigation would look into the system on the rig and determine if a manufacturing flaw were present (which could fault the maker of the system), or conversely, if the system was inadequately or never maintained, an owner or service shop could incur some fault.
The investigation should then look into the actions of the driver of the pickup truck prior to the accident. If the driver was found to be speeding or inattentive at the time of the incident, they too could share some of the liability.
The fact of the matter is that a liability determination from an accident rarely is placed on one entity. As mentioned, it can indeed be spread across multiple parties, which makes a thorough investigation absolutely vital in a civil procedure.
