Commentary Very few details have been made publicly available regarding this accident. Especially in a situation like this, a thorough investigation should be used to determine liability and any relevant civil strategies from the accident. Since there are relatively no details available of the accident, it is very difficult to discuss potential outcomes. I can say, however, that depending on the owner of the truck, there may be investigations conducted currently to mitigate liability on the defendant's end. Defense attorneys do not have to provide a singular theory of liability like a plaintiff must provide. Really any factor to limit their client's fault can be used. This is all done with an eye towards the company's bottom line. On the other hand, if fault is indeed found on behalf of the truck driver, another routine defense attorneys and adjusters employ is the quick, upfront payout to an unsuspecting victim. The settlement will be masked as an effort to quickly help a victim or their family, but is typically well under what an actual accident is worth. In addition, the settlement will most assuredly come with the caveat of precluding any further action against the trucking company.
