Many of the news feeds note the trailer was "legally parked" off the roadway. I question the accuracy of these statements. If just for the fact that a man died from the accident, the veracity should be looked into by an independent investigation.
I say this because the term "legal" has a specific meaning regarding a parked trailer. Say the trailer was parked on the shoulder of the roadway. Truckers are required to leave markers at certain paces behind the trailer in question. We litigated a case a few years ago of a disabled semi pulled over in the shoulder of a road. The trucker failed to place warning markers behind the disabled rig and later a motorist struck the rear of the trailer and suffered major injuries. The point is, many factors can lead to an accident that may not be intuitive to the scene and could allow for some type of civil remedy.
